Introduction
Welcome to Tenantpe.com! These terms and conditions outline the rules and regulations for the use of Tenantpe Pte. Ltd's Website, located at Tenantpe.com.
Tenantpe.com, a technology service (“Service”) operated byTenantpe Pte. Ltd.(“Tenantpe,” “we,” “our,” or “us”). Our Service, offered through the tenantpe.com website (“Our Website”) and our app, provides a platform for home service providers (“Professionals,” or “you”) to register, receive service orders, and manage their business operations. Additionally, it allows consumers to book home services through our app.
Acknowledgement & Acceptance
By accessing or using the Service provided by Tenantpe.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the “Terms” or “Agreement”). This Agreement, along with the Privacy Policy, applies to all users, including consumers and service providers (“Users,” referred to as “you” throughout this Agreement). “User” refers to you as an individual and includes the employer or entity on whose behalf you are using the Service. By using the Service, you represent and warrant that you are authorized to enter into this Agreement on behalf of yourself and such employer or entity. If you do not agree to these terms, you must immediately stop using the Tenantpe Platform.
You agree that we may amend this Agreement at any time by posting a revised version on the Service or our Website or by notifying you directly at our discretion. Your continued use of the Service after any changes are made to this Agreement constitutes your acceptance of such changes. We are not obligated to notify Users of any changes to this Agreement. It is your responsibility to remain informed about the terms of this Agreement.
Service Requests
- Connecting Customers and Professionals: Tenantpe facilitates the connection between Customers seeking services and Professionals offering those services. Customers can make requests for Professional Services via the Website or app.
- Making a Service Request:
- Tenantpe allocates requests to available Professionals based on their availability and internal procedures.
- The acceptance of requests depends on the availability of Professionals in the specified location and time.
- Your request is subject to acceptance by a Professional. Once accepted, Tenantpe will notify you through SMS, push notification, or confirmation screen on the Tenantpe App/Website. If no Professional is available, you will be informed similarly. - Independent Contract: Acceptance and completion of a Service Request create an independent contract between the Professional and the Customer. Tenantpe may share essential details such as service location, Customer’s mobile number, and rating with the Professional to ensure service delivery.
- Post-Acceptance Actions:
- Tenantpe will send the Customer a booking confirmation through the Tenantpe App, including the Professional’s contact details and a picture.
- Tenantpe will provide the Professional with the necessary Customer details to perform the services. - Timeliness of Professionals: Professionals are expected to make reasonable efforts to arrive on time. If there is a delay, Customers should contact the Professional through the Tenantpe App or Tenantpe support.
- Cancellation of Service Request: If a Customer needs to cancel an assigned Service Request, they must immediately contact Tenantpe customer care or cancel through the Tenantpe App. Refunds for payments made for Professional Services are governed by Tenantpe’s Cancellation Policy, as provided or updated on the Tenantpe Platform.
- Promotions and Information: With your consent, Tenantpe or its authorized representative will provide information about services, discounts, and promotions via SMS or email. You can opt-out at any time by visiting the settings page on the Tenantpe App.
- Customer Support: For assistance with the Tenantpe Platform or any Service Request, Customers should contact Tenantpe customer care or email [care@tenantpe.com].
- Contractual Relationship: The contract for Professional Services is exclusively between the Professional and the Customer. Tenantpe and its Affiliates have no obligations or liabilities concerning this contract.
- Platform Services:
Services provided through the Platform include:
- Accepting Service Requests;
- Identifying Professionals to fulfill the requests;
- Monitoring the start and end of service using the Tenantpe App;
- Handling feedback, questions, and complaints;
- Providing customer support for grievances;
All services are provided in compliance with applicable laws.
Use of the Platform
- You agree to adhere to the Acceptable Use Policy while utilizing the Platform.
- When performing transactions or registering an account on the Platform, you certify that:
- You are at least 21 years old;
- You are using your real identity;
- The personal information you provide is accurate, complete, current, and truthful;
- You will maintain and promptly update your personal information to ensure it remains accurate, complete, current, and truthful. - Users under 21 years of age must obtain consent from a parent or legal guardian or use the Platform under their supervision. Parents or legal guardians must agree to these Terms of Service and are responsible for their child's use of the Platform.
- If given a password to access specific parts of the Platform, you are responsible for maintaining its confidentiality and for all activities that occur under your account.
- You agree to notify us immediately of any security breaches involving your password or login details.
- We are not responsible for any loss or damage resulting from your failure to comply with this clause.
Service Data You Provide as a Professional and User
In using the Service provided by Tenantpe, you may provide us, directly or indirectly, with information about yourself or your business. This information, referred to collectively as “Service Data,” may include:
- Licenses: Professionals are requested to provide licensing information. Different jurisdictions may require state and/or local (county or municipal) level licensing for certain services, work, and/or project amounts.
- Customer Data: Individual customer data entered shall remain the property of Tenantpe. You grant Tenantpe and its affiliates and service providers the right to use, reproduce, modify, perform, display, distribute, and disclose such customer data as necessary to provide the Service, including any third-party apps you choose to download from our App Store, to you and other customers, and for Tenantpe’s internal business uses, and any other uses permitted by law, subject to the Tenantpe privacy policy located at [Privacy Policy URL].
- Feedback: If you provide us with any feedback regarding the Service, including any flaws, errors, bugs, anomalies, problems, or suggestions for the Service (“Feedback”), you hereby assign to us all rights, including intellectual property rights, in the Feedback. This includes the right to use such Feedback and related information in any manner we deem appropriate.
- Login Information: You are responsible for maintaining the confidentiality of your account password and all activities that occur under your account. Tenantpe has no liability for any unauthorized transactions or access to your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for your conduct and any use of the Service through your information technology systems or environment, whether authorized or not. We reserve the right to disable any user name, password, or other identifier if we believe you have violated any provision of this Agreement.
- Geolocation Data: We may access certain geolocation data of you and/or your vehicles, obtained from mobile devices, including mobile phones, and third-party vehicle tracking devices. You acknowledge that you have all necessary consents and rights to convey any and all rights granted hereunder to us.
- Payment Processing Information: You may provide certain payment processing information, including but not limited to dates, amounts, and forms of payments you receive. You warrant that all information you provide or submit, including Service Data, is complete, accurate, and current.
Payment Processing Terms of Service
You may have the option to use our payment processing service to make payments via credit or debit card or ACH, subject to our approval of your eligibility. You agree that we may use third-party payment processors ("Third-Party Payment Processors"), and their terms and privacy policies will apply to you. We currently use Stripe as our payment processor. By registering with Tenantpe, you agree to the Stripe Services Agreement and Stripe Connected Account Agreement. Tenantpe is not liable for the acts or omissions of any third party, including any Third-Party Payment Processor.
Indemnities
To the fullest extent permitted by applicable laws, the Customer agrees to indemnify, defend, and hold harmless Tenantpe and its affiliates, including their directors, officers, employees, agents, and representatives (“Those Indemnified”), from and against any direct losses, damages, liabilities, claims, costs, penalties, and expenses (including legal and court fees) incurred by Those Indemnified arising out of or in connection with any of the following:
- Any breach by the Customer of the terms of this Agreement;
- Any breach by the Customer of any applicable law;
- Any misrepresentation or fraudulent, dishonest, unlawful, or negligent act or omission by the Customer in the course of obtaining the Professional Services;
- Any personal injury (including sickness and death) or property damage to Professionals or any third party in connection with the Professional Services (including any harassment or misconduct); or any claim by a Professional or any third party arising from the Customer’s use of the Tenantpe Platform, except to the extent such claim is caused by any act or omission of Tenantpe.
Use of the Platform
Certain uses of our Service contradict our mission to enhance the experience of our Professionals. The following activities are strictly prohibited:
- Child Exploitation: Do not post or upload materials that exploit or abuse children, including images or depictons of child abuse or sexual abuse, or that present children in a sexual manner.
- Harassment, Bullying, Defamation, and Threats: Do not post or upload materials that harass, bully, defame, or threaten any person.
- Hateful Content: Do not use the Service to promote or condone hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status, or other forms of discrimination. Do not support organizations, platforms, or people that promote or condone such hate or violence.
- Illegal Activities: Do not post or upload materials that violate any applicable laws.
- Privacy or Intellectual Property: Do not post or upload materials that infringe on the privacy or intellectual property rights of others.
- Obscene or Offensive Content: Do not post or upload any materials that we, at our sole discretion, find obscene, indecent, or offensive.
- Malicious and Deceptive Practices: Do not use the Service to transmit malware, host phishing pages, or engage in activities that harm or disrupt the operation of the Service or other infrastructure, including that of Tenantpe or its third-party providers. Do not engage in deceptive practices or activities.
- Personally Identifiable or Confidential Information: Do not post or upload materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers or account passwords, without consent from the individual to whom the information belongs.
- Self-Harm: Do not offer goods or services, or post or upload materials that promote self-harm.
- Spam: Do not use the Services to transmit unsolicited commercial electronic messages.
- Terrorist Organizations: Do not offer goods or services, or post or upload materials that imply or promote support or funding of, or membership in, a terrorist organization.
- Service Bureau: Do not use the Services for timesharing or service bureau purposes or otherwise for the benefit of a third party, unless specifically authorized herein.
We reserve the right to remove any materials and suspend or terminate your account or access to the Service at any time and without notice if you engage in activities that violate this Agreement.
No Representations or Warranties
We make no representations about the suitability of the content or services provided by this Service for any purpose. We do not guarantee that the Service will be error-free, uninterrupted, or that it will provide specific results from its use. We make no claims that your website will meet the requirements of the Americans with Disabilities Act or any other law, regulation, or ordinance governing accessibility. The Service and its content are delivered on an “as-is” and “as-available” basis.
We disclaim any liability or responsibility for errors or omissions in the content, downtime of the Service, your actions or inactions in connection with this Service, or any damage to your computer or data or any other damage you may incur in connection with this Service. We specifically disclaim all warranties and conditions of any kind, express or implied, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement. We make no guarantees of any specific result from the use of this Service. Your use of this Service is at your own risk.
From time to time, we may recommend, provide you with access to, or enable third-party software applications, products, services, content, or website links, including third-party services (“Additional Services”) for your consideration or use. These Additional Services are provided for your convenience only, and we make no representations or warranties of any kind regarding such Additional Services.
Security
We have implemented technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, or disclosure. However, we cannot guarantee that unauthorized third parties will not be able to defeat those measures or use your personal information for improper purposes. You acknowledge that you provide such information at your own risk, and that we have no liability to you or any third parties due to any unauthorized access to your Tenantpe account.
Blocking of IP Addresses and UDIDs
In order to protect the integrity of the Service, we reserve the right, at any time, in our sole discretion, to block Users from certain IP addresses and UDIDs from accessing the Service.
Termination
- Tenantpe may terminate this Agreement immediately upon notice to the Customer if: (a) it is necessary to comply with any applicable law; (b) to protect the interests of Tenantpe or its affiliates in the event of inappropriate acts or omissions by the Customer; (c) the Customer breaches any terms of this Agreement; or (d) for convenience.
- Upon termination of this Agreement for any reason: (a) the Customer’s rights to use Tenantpe Services will cease immediately, the Customer's registration and Account will be terminated, and Tenantpe may block access to the Tenantpe App; (b) the Customer must pay all amounts due and owed to Tenantpe up to the date of termination; (c) both parties must cease any actions implying a continuing relationship under this Agreement.
- The following sections will survive termination: Confidentiality, Privacy, Intellectual Property Rights, Indemnities, Liability, Termination, and Governing Law and Dispute Resolution, along with any other terms that by their nature should survive.
- Termination of this Agreement will not affect any rights or obligations that have accrued prior to the termination.
